Study Permit Extension Refusals and Appeals Procedure

March 29, 2021BY Anik Chowdhury

Studying in Canada requires a study permit. And as a foreign national studying abroad, having your study permit extension refused is the most unsettling event ever. Study permits are issued by the Canadian Immigration Office. Unfortunately, there are a number of reasons for which you can see your study permit extension rejected. Regardless, we agree that it is a major blow for your plans to renew or extend your study permit and settle in Canada.

Even though you always have the chance to apply back, but there is no guarantee that it will surely work. Lucky for you because I will tell you the method to apply correctly, so that study permit extension becomes an easy process for you.

If your study permit extension gets canceled in the worst-case scenario, you will lose your studentship at your college or the university. It also means you will be deported without completing your degree. And so, in this article, I promise to tell you everything you need to know to renew your study permit.

If your study permit extension is refused, your first question should be –

What Options do I Have after Being Refused?

There are two things to do if your study permit is refused by the Immigration, Refugees and Citizenship Canada (IRRC),

Appeal the Given Decision

You have the option to challenge the decision if you sincerely believe that your application meets all the requirements as mandated by the IRRC. In other words, if you believe your study permit was wrongly or unfairly declined, then you can always appeal the decision and request to consider the matter again.

Submit a New Application

If the applicant has solid reasons to believe that the grounds for refusal are legit, there is only one way left – submit another application. The candidate should be extra careful about the new application so as to address the previous grounds for refusal and if any of the documents require updating. The updates can be on things like – starting date on the acceptance letter, updated bank statements, etc.

What Should I Do If My Application is Refused?

Every study permit that gets dismissed is always addressed with an alarming issue. So, your next action should depend largely on the notes given by the visa officer, whether it is valid or not. Further assessment of the issues and notes addressed by the officer should tell whether to apply again or not.

The issue(s) are noted within the letter issued by the visa officer from a list of predefined possibilities and given to the refused applicant. The listing is a basic reason for which the application was rejected, and it requires more context to take further actions.

And so, it is extremely important for the candidate to request and collect the case notes given by the officer so as to address the refusal in the best possible way. On obtaining the notes, the candidate can assess whether the ground for the refusal is valid or not.

For example – if the application was rejected because of the absence of updated documents, then the candidate needs to resubmit a new application after collecting all the errors stated in the case notes.

Contrarily, if the applicant is confident that the grounds for refusal were invalid, then he/she can apply and submit the documents again by requesting a reconsideration. It is important to know that the application process and the resubmission take a considerable amount of time.

Possible Reasons for Study Permit Extension Refusal

Canadian study permit applications are refused for a number of crucial reasons, which is clearly indicated in your refusal letter issued by the IRCC. Here are some of the most common reasons for study permit extension refusal –

1. Proof of Financial Support

One of the most important questions a visa officer will ask the candidate is about the financial support for the student. Simply put – the candidate needs to present all relevant documents to prove that he/she has sufficient funds to support him/herself in Canada.

In fact, the IRCC mandates that all foreign nationals need to submit enough proof that their studentship in Canada is covered by sufficient funds. These funds will be invested in areas like – tuition fees, cost of living for the student, and any accompanying member (if any).

What is The Best Way to Appeal Against a Problem with Proof of Financial Support?

Having your application rejected due to inadequate financial support may mean two things.

One – your financial support is weaker than what is needed for a student visa application in Canada.

Two – your application does not have all the relevant information to prove that your financial background is strong and sustainable.

So, the best way is to review the notes addressed by the visa officer and address the concerns accordingly. Make sure to add new and updated information before reapplying for reconsideration.

2. Your Intention to Leave the Country

A study visa is temporary permission to stay in a foreign country for the purpose of studies. This means it is only valid for a certain time and surely has an expiry date. In your personal statement, you need to present the fact that you will return to your native land after completing your education and, stating that your sole intention of applying for a student visa in Canada is to receive a better education.

But that does not mean you cannot extend your study permit or decide to stay permanently. Yes, you can do that, obviously. In fact, the government of Canada has many programs to help overseas students to help them find work and transition to permanent residence in Canada.

The underlying fact here is that – as a candidate, you need to earn the trust of the visa officer so that he/she has reason to believe that you will not reside in Canada illegally when your visa expires. So, it is a good practice to write in your personal statement a solid reason to return home after completing your studies.

What is The Best Way to Address A Problem of Intent?

Your personal statement is the best and the most effective document where you can clarify your intent for studying abroad and also putting in details about what you would like to do after finishing your studies. As a candidate, you need to establish a strong and logically sound narrative that makes the visa officer believe that you have good intentions to study in Canada. And so, you would have to rework your statement if the officer finds it unconvincing to give you a student visa.

Note: It is also possible to pursue a permanent and a temporary residence in Canada. You can do this by claiming dual intent in your application and creating a narrative accordingly.

3. Your Choice of Program

Your choice of the program must be relevant to your intent to studying abroad. For example – a student with a Bachelor’s Degree in Nursing and working experience in nursing is applying for a higher degree in Hotel Management – this will surely be questioned. This is because the candidate’s intent does not comply with his/her educational background or employment history.

Even though the candidate may have a narrative of his/her own, the visa officer will surely be thinking otherwise as it makes no sense to make such a transition.

What is The Best Way to Address the Choice of Study Program?

If your choice of the study program is totally different from your past educational background and your working experience, then the best way to express your concern is by presenting a strong narrative in your personal statement.

You need to show enough reasons to convince the immigration officer that your transition is a consensual choice, a choice driven by passion, or anything that is logically acceptable. Besides, seeing the visa officer’s note should also help you to rework your narrative if your application got rejected in the first place.

4. Your Acceptance Letter

In order to obtain a study permit in Canada, the candidate needs to obtain a letter of acceptance from a Designated Learning Institution (DLI) in Canada. You have to submit the acceptance letter for the immigration officer to verify the originality of the document.

If the officer doubts the originality of your acceptance letter, or if you have fulfilled all the requirements for the program – he/she might reject your application.

What is The Best Way to Address the Issue with Acceptance Letter?

Have your documents review to see if all the information is clear and easily understandable. If you can provide additional documents, make sure to do so. Besides, you can email the DLI that issued your acceptance letter stating the officer’s concern.

5. Travel Visa or Identity Documents

The IRCC will reject your study permit visa if you do not have proper travel visa or identity documents. This is because the IRCC needs to identify and determine whether you are criminally or medically inadmissible, in which case your application will be refused.

What is The Best Way to Address the Issues with Travel or Identity Documents?

See the visa officer’s notes left in the first application to find out if there is any information gap in your travel history. Review the documents and address the problems before you reapply, and make sure to add supporting evidence to cover those periods.

If the officer finds a problem with your identity, review the notes and make sure your application is clear and easily readable.

Why does Student Visa Application in Canada Take So Much Time?

One last thing to remember is – student visa application process is a lengthy one and it is different from the process in the US. The US student visa application process, has an interview process where you need to physically present the importance of your student visa in front of a visa officer.

But that process does not apply in Canada simply because the IRCC does not conduct interviews, i.e., the selection process is entirely based on the submitted papers. And so, the application requires detailed personal, family, and financial information and any other relevant documents that support your student visa application.

It is important to prepare a strong application so that the visa officer can consider every aspect to consider your student visa application based on your given information.

Before the Coronavirus swept the globe, the Canadian government was openly considering student visa applications from across the world. Turn the time, and in 2021, the Canadian government has closed the borders and currently taking no applications for the overseas study program. But it is expected that the borders will open soon once the pandemic situation is alleviated with proper vaccination.

And so, in order to get accepted on the first try, you need to know all the ways in which your applications can get accepted and have them reviewed multiple times before submission. This is important because the application vetting process is complicated and takes a lot of time. And I hope this article will help you in every way to save your study permit extension from getting refused.
